Terms of Service

Article 1 (Scope and agreement)

These Terms define the rights and obligations between the Site (KeyTube Transcription) and users regarding use of the Site and all services provided through it, including paid subscription services (collectively, the Service).

By browsing, using, or registering an account on the Site, you are deemed to have agreed to all contents of these Terms and the Privacy Policy.

If you are a minor, you must use the Site with the consent of a legal guardian.

Rules, guidelines, and notices separately defined by the Site form part of these Terms.

Account information may be used together with other related services provided by KeyTube and will be properly handled in accordance with this policy and each service's policies.

Article 2 (Definitions)

1. The Site: The website provided under the domain https://transcription.keytube.net/ and all related services.

2. The Service: All features provided through the Site, including free features and paid subscription services.

3. User: Any person who browses or uses the Site (including Members defined below).

4. Member: A user who agrees to these Terms and completes registration in accordance with Article 5.

5. Subscription Service: Paid services available to Members who pay the prescribed usage fees.

6. Content: All information on the Site, including text, images, videos, audio, and programs.

7. Intellectual Property Rights: All copyrights, trademark rights, patent rights, and other intellectual property rights.

8. Account Information: Member information obtained and managed in connection with external services such as Google or Apple accounts.

Article 3 (Prohibited conduct)

Users must not engage in the following acts or any acts the Site deems inappropriate:

1. Acts that violate laws or public order and morals

2. Acts related to criminal activity

3. Acts that infringe the intellectual property, privacy, honor, or credit of others

4. Acts that destroy or interfere with the Site's or others' servers or networks

5. Acts that obstruct operations or register false information

6. Unauthorized access or data collection using automated means (crawlers, bots, scraping, etc.)

7. Any other acts the Site deems inappropriate

Article 4 (Intellectual property)

All intellectual property rights related to the Service and the Site belong to the Site or its licensors.

Users may not reproduce, transmit, modify, or distribute content beyond what is explicitly permitted by these Terms.

Article 5 (Membership registration)

Users who wish to register must agree to these Terms and complete the procedures specified by the Site.

The Site may refuse registration if:

(1) The registration information is false or incomplete;

(2) The applicant has previously had membership revoked for violating the Terms;

(3) The applicant is or is deemed to be part of antisocial forces;

(4) The Site otherwise judges the registration to be inappropriate.

Article 6 (Account management)

Members are responsible for managing their account information appropriately and must not allow third parties to use, transfer, or lend their accounts.

Members bear responsibility for damages resulting from inadequate account management, except in cases of the Site's intentional misconduct or gross negligence.

Article 7 (Establishment and start of subscription services)

A subscription contract is formed when a Member agrees to these Terms and completes the application and payment procedures.

The Site begins providing the service immediately after payment is completed.

Article 8 (Fees and payment methods)

1. Fees are as listed on the plan page and include consumption tax and payment processing fees.

2. Payments are processed via Stripe, and credit cards, Apple Pay, Google Pay, and Link are supported.

3. Contracts renew automatically each month unless cancellation procedures are completed before the day before the next billing date.

4. Free minutes are granted automatically after registration, and if you move to a paid plan within one month of registration, available free time carries over.

Article 9 (Cancellation and refunds)

To delete your account, please apply via the inquiry form. After confirmation, we will respond within seven business days. If you do not cancel by the day before the next renewal date, the following month's fee may be charged automatically.

Because of the nature of the Service, fees already paid are non-refundable. However, if transcription failed due to a system issue, contact us within seven days and we will provide support or refunds as appropriate.

Article 10 (Data handling and deletion)

Uploaded audio and video data are automatically deleted after transcription. Generated transcription data (JSON/TXT/SRT/VTT etc.) are stored securely and can be deleted anytime from the dashboard.

For storage optimization and stable service, transcription data (such as result files) that have not been updated for over one year may be deleted without notice. Please download data beforehand if needed.

Once an account is deleted, data cannot be restored.

Article 11 (Suspension or deletion of accounts)

If the Site determines that a user has violated the Terms or engaged in fraudulent conduct, it may suspend or delete the account without prior notice.

If there is no activity for 36 months or more, the Site may delete the account and related data without notice.

Article 12 (Changes, suspension, or termination of the Service)

The Site may change or suspend all or part of the Service without notice for business or maintenance needs.

If a continuous outage or similar issue lasts seven days or more, the Site will provide refunds or equivalent extensions for that period.

When terminating the Service, the Site will, in principle, give at least one month's notice and provide an opportunity to save data if necessary.

Article 13 (Disclaimer and limitation of liability)

The Site does not guarantee the accuracy, completeness, usefulness, or fitness for a particular purpose of the Content.

The Site is not liable for damages incurred by users except in cases of intentional misconduct or gross negligence by the Site.

If liability arises, compensation is limited to the amount of usage fees for the most recent one-month period.

Article 14 (Handling of personal information)

The Site handles users' personal information appropriately in accordance with the Privacy Policy.

Article 15 (Changes to the Terms)

The Site may change these Terms as needed. Changes and effective dates will be announced in advance on the Site, and continued use after the effective date constitutes agreement to the revised Terms.

Article 16 (Severability)

Even if any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in effect.

Article 17 (Governing law and jurisdiction)

These Terms are governed by the laws of Japan.

Disputes arising in relation to the Service are subject to the exclusive jurisdiction of the district court having jurisdiction over the operator's location as the court of first instance.
